ARTICLE 12 &=13 LAYOFFS AND RECALL <br />W.9412.01 Notice. Whenever the Employer determines that a layoff is necessary it will <br />provide those affected gpwiio&W� regular full-time employees shall begiven a minimum of two <br />(2) weeks advance notice of layoff. <br />W.91 12.02 Order of Layoff. Whenever the Employer determines that it is necessary <br />£Mays to reduce its forces, the employees within the affectedjob classification, to be reduced, <br />will be laid off in the following order <br />(a) Students and seasonal employees; <br />(b) Part-time; <br />(c) Employees who have not completed their probationary period; <br />(d) Regular full-time employees within the affected job classification who have <br />completed their probationary period; <br />(e) In the application of the foregoing, employees will be retained by reason of their <br />seniority only if they are able to perforin the available work. <br />(f) For the purpose of this Article, students participating in school or other subsidized <br />related work programs or employees working part-time under county or other <br />subsidized programs shall not be included in the definition of students under <br />subsection (a) or part-time employees under subsection (b) of this Article. <br />1 12.03 Order ofLavoff/Disnlacement Rights. Regular full-time employees shall be laid off <br />on the basis of their seniority within their classification. except that when there is a reduction in <br />force, if the the Union President and up to two (2) other Union officers or stewards <br />would be either <br />laid off or bumped, as part of a reduction process, such employees shall be retained and the <br />reduction will affect the next least senior employee in the affected job classification and <br />department if applicable. In the event that there are no other members in the job classification <br />that this exemption would otherwise apply to, those union officials will be reduced, but able to <br />exercise bumping rights. The President shall designate the other Union officers or stewards in <br />writing, annually, to the Employer. When the seniority or service of two or more employees is equal, <br />employees shall be laid off by the drawing of straws. In the event an employee cannot hold his <br />present classification, he shall have the right to "bump" an employee with lesser seniority in an <br />equal or lower rate classification within the same classifrcation series within the same <br />division/depariment For purposes of division department, the fallowing are in place: 1) Police <br />DivisiomViept. 2) Building Division/Dept 3) Finance DivisiomDept 4) Recreation <br />DivisiomDept. 5) Engineering Division/Dept , <br />12.04 Vacation Payout In the event an employee is laid off, he/she shall receive payment for <br />any earned but unused vacation as quickly as practicable, but no later than fourteen (14) calendar <br />days after the layoff. <br />13 <br />4863-1214-9430, v.2 <br />
