All unpaid disability leaves of absence when <br />known in advance (and any extensions thereof) must be applied for and granted in writing on forms <br />provided by the Employer (copy to the employee). The employer will notify ?as the employee and the <br />Union will h a mstifiud within five (5) working days from the date the application was made of approval <br />or denial of the request leave. <br />(b) 35.02 Seniority and Benefit Continuation during Unpaid Disability Leave. An employee <br />shall accumulate seniority during any unpaid leave of absence, but he shall not be entitled to any <br />benefits, except that the Employer shall continue to pay its portion of the employee's hospitalization <br />insurance during an unpaid FML period' . After the three (3) <br />menih FML period, an employee must direct pay any required hospital/surgical premiums to the <br />Employer on or before the monthly due date and comply with the other applicable requirements for <br />making a COBRA election. <br />(o) 35.03 Request for Reinstatement following Unpaid Disability Leave. An employee seeking <br />to V%en see empWyou returns to work after a leave of absencerboAbo will my be assigned to the <br />position which he/she formerly occupied at the then current rate of pay, or to a similar position if <br />his/her former position no longer exists, if he/she is medically qualified <br />and capable of performing the job requirement as determined by the Employer. In the event the <br />Employer questions whether the employee is kyr <br />medically qualified to do the work the Employer shall have the employee medically examined <br />and pay for such examination. <br />35.04 Improper Reauest for Leave/Abuse. If it is found that a leave of absence is not actually being <br />used for the purpose for which it was granted, the Employer shall cancel the leave and it may impose <br />disciplinary action up to and including discharge. <br />35.05 Unpaid Personal Leave. An employee who has completed his probationary period may be <br />granted a ninety (90) calendar day unpaid personal leave. During such period the employee, in <br />order to maintain any and all benefit which are paid by the City, shall be required to pay to the <br />Director of Finance, the cost of such benefits, in advance, on a monthly basis. <br />12 <br />48637214-9439,, 2 <br />
