ARTICLE # 36 MILITARY LEAVE <br />I!-@! -44 436.01 Employees shall receive military leave rights and benefits pursuant to <br />the Ohio Revised Code and Federal Law. (Make Separate Article, Military Leave with Current <br />Language) <br />ARTICLE 44 37 FMLA LEAVE <br />W.02 1445A]scmwi 37.01 A regular full-time employee shall be provided with FMLA leave <br />pursuant to federal law. (Make Separate Article, FML Leave with Current Language) <br />ARTICLE 4438. PROMOTIONS 911001ING TRAN91PERS AND JOB <br />TRAINING/CONTINUING EDUCATION/EXPENSES <br />4&5 38.01 Employees shall be trained during working hours on computers and or other <br />equipment. The following positions shall require the ability to use word presessere and computers: <br />Secretary I, Secretary II, Permit Clerks, Police Secretaries, Building Inspector, Head Cashier, and <br />Engineering Inspector. <br />14,44 38.02 Building Inspectors who attend continuing education classes during the day for re- <br />certification purposes, shall be allowed to use Employer owned vehicles for attendance at these <br />classes or provided mileage in accordance with City policy. <br />ARTICLE 39 COMPENSA TORY TIME <br />39.01. Comoensatory Time/Maximum Accrual Each employee shall have the right to convert <br />overtime hours into compensatory time at the applicable rate (1.5x regular hours/holiday hours <br />as applicable) for each overtime hour worked. Employees shall be capped at no more than one <br />hundred twenty (120) hours of compensatory time at any given time. <br />39.02. Request/Approval Procedure. Employees may have the right to take compensatory time <br />with a 48-hour advance notice and when the time off does not interfere with the operation of <br />the applicable Department. The taking off of such compensatory time shall be subject to the <br />approval of the Department Head/designee. Additionally, the parties agree that where an <br />employee has been denied the usage of compensatory time on a specific date, he may be offered <br />an alternative dayfor compensatory time usage within the next thirty (30) days, be offered cash <br />payment for the amount of hours denied, or the employee may withdraw his request for usage. <br />It is the employee's choice in electing any of the offerings. The parties specifically agree that <br />thirty (30) days constitutes a reasonable time period for satisfying a request for compensatory <br />time usage under the Fair Labor Standards AcL Except as otherwise specifically restricted by <br />this Agreement, the Employer retains all rights to manage the administration of compensatory <br />time under federal law, which includes, but is not limited to the right to schedule such time off <br />or payoff compensatory time banks. <br />13 <br />486&1214-943,, 2 <br />
