39.03. Annual Conversation. An employee shall be paid for unused, accumulated <br />compensatory time at his or her current rate of pay plus longevity at the end of each calendar <br />year. An employee or his estate shall be paid jor unused, accumulated compensatory time at the <br />time of disability, retirement or death at the basic hourly rate of pay for his workweek plus <br />longevity if applicable. <br />39.04. Compensatory Time Scheduling Limits. Compensatory time shall be taken in eight (8) <br />hour blocks or in four (4) hour blocks at the start or end of a shift. All compensatory time <br />requests that are not in compliance with requirements set forth in this contract will be subject <br />to the approval of the Service Director or his designee on a case by case basis. <br />ARTICLE 40 DISCIPLINARY PROCEDURE <br />40.01 Discipline/Types of Action. The tenure of every non probationary employee subject to <br />the terms of this agreement shall be during good behavior and efficient service. The Employer <br />may take disciplinary action against any employee in the bargaining unit for just cause. The <br />Employer may take disciplinary action for actions which occur while an employee is on duty, or <br />which occur while an employee is working under the colors of the Employer, or in instances <br />where the employee's conduct violates his oath of office, or applicable rules and regulations. <br />Forms of disciplinary action are: <br />1. Written/Verbal warning <br />2. Written reprimand <br />3. Suspension without pay (at the option of the employee, and with the concurrence of the <br />Employer, accrued vacation or holiday time may be forfeited equal to the length of the <br />suspension. Record ofsmpension will be maintained) <br />4. Reduction in pay or rank <br />5. Discharge. <br />6. Suspension of record (L e., papedworking suspension). <br />An employee who is given a suspension of record (Le., papedworking suspension) shall be <br />required to report to work to serve the suspension and shall be compensated at applicable wage <br />for hours worked. The working suspension shall be recorded in the employee's personnel file <br />in the same manner as other disciplinary actions having the same effect as a suspension without <br />pay for the purpose of recording disciplinary action. Any employee who is subject to a working <br />suspension, and that disciplinary action is subsequently arbitrated, shall have any portion of the <br />suspension upheld converted to an unpaid suspension, to be served as unpaid time or through <br />the forfeiture of paid leave, at the discretion of the Employer. <br />40.02 Notice ofDiscipline. 6 -.04 -In case of a suspension or discharge or a formalized disciplinary <br />meeting, the employee shall have the right to have his/her steward present and, upon request, will <br />be permitted to discuss his/her suspension or discharge with the steward in the area made available <br />by the Employer before he/she is required to leave the premises. <br />Within owe", fawn 24) forty-eight (48) hours of the date of a suspension or discharge, the <br />Employer shall deposit with the regular U.S. Mail, a certified letter to the involved employee <br />14 <br />4863-12149430, v 2 <br />
