<br />Director of law Gareau:
<br />• Director Gareau reported that Kovach Group, U.C. has filed an appeal in the Eighth District Court
<br />of Appeals with regards to the Court of Common Pleas decision in the case of Kovach Group,
<br />U.C. vs. The City of North Olmsted Building Zoning Board of Appeals (KAVA Bar). Director
<br />Gareau noted that the Law Department will defend that decision and added that he expects a
<br />favorable decision in that court as well. Lastly, Director Gareau noted that it will take some time
<br />for the Court of Appeals to reach a decision, and updates will be provided once available.
<br />Director of Finance Copfer:

<br />Councilman Limpert, Chairman of the Building, Zoning and Development Committee:
<br />The Building, Zoning and Development Committee met on Tuesday, April 23, 2024 at 7:00 p.m. Present
<br />were Committee Members Limpert, Glassburn and Gilchrist and Council Members Scarl, Madden,
<br />Hemann and Shymske, Mayor Jones, Law Director Gareau, Human Resources Director Kidd, Director of
<br />Economic and Community Development Upton, Safety Director Scofield, Service Director Kearney,
<br />Recreation and Public Engagement Director Pinchek, Special Assistant to the Mayor Massarolo and
<br />guests.
<br />• Discussed PDC Case 24 -PLAN -31-2024 Dog Training Elite. Councilman Limpert reported that this
<br />is for a conditional use permit for a dog training daycare facility. He noted that Director Upton
<br />confirmed that the proposal met all standards, including distance requirements from residential
<br />zones. Additionally, Councilman Limpert noted that there were no outdoor or exercise areas
<br />and the animal excrement will be taken off-site for those concerned about health issues. The
<br />Committee voted 3-0 to favorably recommend.
<br />• Discussed PDC Case 23689-P010 Woodland Grove. Councilman Limpert reported that Director
<br />Upton noted that this is a project consisting of 14 housing units. He noted five different
<br />variances that have been approved in order to accommodate and align with the Planning
<br />Commission's review of the property configurations. The Committee had a discussion around
<br />the plan not including any sidewalks, and it was determined that more discussion was needed.
<br />The Committee voted 3-0 to hold in Committee, and the Committee Meeting concluded at 7:34
<br />p.m.
<br />Councilman Limpert moved to approve PDC Case 24 -PLAN -31-2024, Dog Training Elite. The motion was
<br />seconded by Councilman Glassburn and passed 7-0.
