ix-6ee PPI and is later rehired, he shall be considered as a new employee and subject to the <br />provisions of Section 1. <br />ARTICLE 4311: <br />LAYOFF AND RECALL <br />SECTION 1. NodcelMeetines. Whenever the Employer determines <br />that there exists a lack of funds, lack of work, or that a reorganization in the operations of the <br />Employer is necessary, a reduction in force (Le., layoff or job abolishment) shall occur. of <br />�aiiiexs; <br />The Employer shall notify the effected employees in writing at least thirty (30) €eta <br />(44) -days in advance of the effective date of layoff. The Employer, upon request from the OPBA, <br />agrees to advise the representatives of the OPBA, the impact of the layoff on bargaining unit <br />employees. <br />SECTION 2. Order ofLavo(f. The Employer will determine in which classification a reduction <br />is to be made, and within the affect classification -Remployees shall be laid off in accordance with <br />their departmental seniority, last hired, and first laid off. � Within the affected <br />classification, before any full-time employee is laid off, all part-time dispatchers will be first laid <br />off. <br />SECTION 3. Recall Riehis. Employees who are laid off shall be placed on a recall list for a <br />period equal to their length of service not to exceed twenty-four (24) months. If there is a recall, <br />employees who are still on the recall list shall be recalled in the inverse order of their lay off, last <br />laid off, first recalled. <br />SECTION 4. Notice of Recall. Notice of recall shall be sent to the employee(s) by registered mail, <br />with a copy to the OPBA, and shall include the date when the employee is to report back to work. <br />The Employer shall be deemed to have fulfilled its obligation by mailing the recall notice by <br />registered mail, return receipt requested, to the last mailing address of the employee. <br />SECTION 5. Reportine Timeline Following Recall. The recalled employee shall have fifteen <br />(15) calendar days following the date of receipt of the recall notice, to notify the Employer of the <br />employee's intent to return to work. The recalled employee must report back to work on the date <br />set forth in the notice of recall or shall forfeit his or her recall right. <br />SECTION 6. Preemption. It is the intent of the parties, through this article, to establish an <br />objective procedure by which a reduction in force (Le., layoff or job abolishment) may be <br />accomplished, should the need arise, and supersede the provisions of ORC 124.321 to 124.328, <br />124.37, OAC 123:1-41-01 to 123: 1-41-12, and all local rules and regulations of the City of <br />North Olmsted Civil Service Commission governing workforce reductions. <br />ARTICLE 4413: <br />MISCELLANEOUS BULLETIN BOARDS <br />.. <br />whore theP ��6 ....A.. .. <br />12 <br />4882-1e15-28o7,� 5 <br />
