This Agreement is made between the City of North Olmsted (hereinafter referred to as the <br />("Employer"), and the Fraternal Order of Police/Ohio Labor Council (hereinafter referred to as the <br />"FOP',). <br />The purpose of this Agreement is to provide a fair and reasonable method of enabling employees <br />covered by this Agreement to participate, through representation, in the establishment of terms and <br />conditions of their employment, and to establish a peaceful procedure for the resolution of <br />differences between the parties. <br />ARTICLE 1 <br />RECOGNITION <br />1.01. Included. The Employer recognizes the FOP as the sole and exclusive bargaining <br />representative for all full-time Corrections Officers of the Employer for the purpose of collective <br />bargaining with respect to wages, hours, terns and other conditions of employment. <br />1.02. Excluded. The Chief ofPolice,Captains, andatiotheremployeesnotspecijually included <br />in Section 1.01 shall be excluded from the bargaining unit <br />ARTICLE2 <br />BARGAINING LMT WORK <br />4�Q 2.OT Bargaining Unit Work. Management shall not attempt to erode the bargaining units <br />or the rights of bargaining unit employees. Except in emergency circumstances, work normally <br />performed by bargaining unit members shall fust be offered to bargaining unit members. <br />ARTICLE 8 3 <br />NON-DISCRUM NATION <br />4.44-3-01. Federab5tate Discrimination Allegations. Both the Employer and the FOP recognize <br />their respective responsibilities under the Federal and State Civil Rights Laws, Fair Employment <br />Practices Acts, and other similar constitutional and statutory requirements. <br />s€ The parties recognize and acknowledge that any allegation of discrimination based <br />on a legally protected classification under Federal or State law shall be processed through <br />external administrative agencies (ie., EEOC/OCRQ. <br />a.443.02. Union Affiliation. The Employer agrees not to interfere with the rights of employees <br />to become members of the FOP and there shall be no discrimination, interference, restraint or <br />coercion by the Employer or FOP representatives against any employee(s) because of FOP <br />membership or lack of FOP membership. <br />3.03. Interactive Meetings. In the interest of attempting to resolve outstanding issues that <br />may befded under this Article, or would be otherwise appealed to an external administrative <br />agency (SERB, EEOC, or OCRQ, the Employer, member involved, and appropriate <br />representative may meet as soon as practicable in an effort to resolve the alleged violation <br />486357139656, v. 5 <br />
