44:94 18.01. De coition. The term grievance shall mean an allegation by a bargaining unit <br />employee that there has been a breach, misinterpretation, or improper application of this <br />agreement. <br />44.W Group Grievances. A grievance may be filed by any member of the bargaining unit. <br />Where a group of bargaining unit members desire to file a grievance involving a situation affecting <br />the group, a member shall be designated by such group to process the grievance. Such grievance <br />shall be defined as a group grievance. The names of each member, on behalf of which the <br />grievance is filed, shall be made available at the first hearing. Group grievances shall be presented <br />in the first instance to the supervisor common to all employees in the group. The grievance <br />procedure outlined in Section 4418.05 shall be used throughout. <br />4.$318.03. Grievance Processing/Time Limits. All grievances must be processed and answered <br />at the proper step in the grievance progression to be considered at the next step. Any grievance <br />that is not timely appealed to the next step of the procedure will be deemed to have been settled <br />on the basis of the Employers answer at the last completed step. <br />Time limits set forth herein may only be extended by mutual agreement of the parties. The <br />aggrieved may withdraw a grievance at any point by submitting, in writing, a statement to that <br />affect, or by permitting the time requirements at any step to lapse without further appeal. Any <br />grievance not answered by the Employer or his designee within the stipulated time limits shall be <br />considered to have been answered in the <br />negative and may be appealed to the next step in accordance with the applicable time limitations. <br />Any grievance not presented within the time limits set forth in this article shall not be entitled <br />to consideration. <br />For purposes of calculating time limits, "calendar days" shall be calculated to include all <br />regular business days during which the administrative offices are open, excluding weekends <br />and holidays. Where the deadline for action falls on a weekend or holiday, the deadline shall <br />be considered to be the neat regular business day. <br />44-9418.04. Grievance Contents. Written grievances must be filed on the form provided by the <br />FOP and shall contain, but not be limited to, the following information: <br />1. Date and time grievance occurred; <br />2. Description of incident giving rise to the grievance; <br />3. Articles and sections of the agreement involved; <br />4. Relief requested; <br />5. Signature of the employee. <br />4.$318.05. Grievance Procedure. The following steps shall be followed in the processing of a <br />grievance. <br />Step 1. Within seven (7) working days of the incident or knowledge of the incident, the aggrieved <br />employee shall submit his written grievance to the Shift Lieutenant, or his designee, who shall <br />indicate the date and time of receipt of the grievance, and affix his signature to the grievance form. <br />18 <br />4863-5713%56, v. 5 <br />
