The cases were resolved through a diversion program over in Rocky River Municipal
Court that required the engineering and lot split assembly followed by development
plan review, which we would have expected to be done normally with buffering and
fencing and finally building permits pulled, for what was already a substantially
improved lot, with improvements already made without the permits. There were some
delays along the way, and it did take a period of time and eventually the administrative
review caught up, but the diversion program, much like a function of probation over
there, is really designed, again, to get voluntary compliance and in this case to get
everybody on the same page, so that we could get a good result. So we utilized that
program and the Building Department has now reported the site, a new construction
been approved for inspection, granted occupancy and the business is doing well. So it's
good for North Olmsted, but it's also ensuring that the rules get followed, so that the
adjacent property owners aren't affected in a way, and that everybody's on the same
page. So it was a good result.
We have another situation where we're also in prosecution is Phil Seitz at 5035 Porter. 1
shared photos of this with you last year. It is a situation; I would describe as severe. The
debris and amount of, I would call it debris, random items of personal property strewn
about the yard, make a challenging situation for us because the city and the neighbors
are up in arms as one would imagine. Some people had arranged for volunteers to help
the owner of the property, he's a veteran. There were some veterans' groups that came
in and then it just kind of fell apart. That matter is going to, unlike the first case where
we had diversion, in this case it's set for sentencing on May 14, 2025 at 9:00 a.m., but
we'll see if we can gain compliance by then, and we'll see if we can urge that to the
Building Department as well.
Another case I told you about a while ago was Robert Ryder vs. The City of North
Olmsted. A complaint filed with the Ohio Civil Rights Commission. This case again has
been fully briefed. All information and materials have been complied, and requests for
information materials have been fully complied with by the city. It is with an investigator
and we're awaiting a determination as to what occurs next.
Finally, for those of you who had the pleasure of knowing Tom Hatfield, I had the
pleasure of knowing Mr. Tom Hatfield, here from the City of North Olmsted. A long-
time teacher, I didn't have him as a teacher, but certainly knew him as a resident, a
founding member of the NOSO Soccer Organization, a long-time teacher for the City of
North Olmsted, and a soccer coach which culminated in a 1977 State boys title. Soccer
kind of exploded in the area in the 70s, and he was right there. So he was there as a
coach winning a title, and he was there to create the NOSO program which I don't know
if everybody here...? I was in it. The number of North Olmsted folks that had their
children, or played in it themselves, is a lot. He passed away this week, and to keep his
family in your prayers, thank you. That's my report, thank you.
Council President Brossard:
Thank you. Director of Finance Copfer, do you have a report this evening?
03-18-25 Council Meeting Minutes - Page 3
