d. Evidence shall be presented that the proposed facility meets the certification, <br />licensing, or approval requirements of the appropriate state agency. Failure to <br />maintain such license, certification or other approval requirements shall result <br />in immediate revocation of the facility's Conditional Use approval. <br />e. This facility shall be located at least one thousand feet (1,000') from another <br />such facility, Distances are measured from lot line to lot line by the shortest <br />distance. <br />2. Assembly Hall or Conference Center. <br />a. The proposed use shall not generate noise in excess of the limits stated in <br />Chapter 555 Noise Control of the City of North Olmsted Codified Ordinances. <br />b. Any part of such establishment fronting a primary street should be located so <br />as to minimize the amount of space that is inactive during normal business <br />hours. Such facilities are encouraged to have associated retail or active uses <br />located in the first -floor space nearest the street or sidewalk to contribute to <br />the retail environment of the Zoning District. <br />3. Brew Pub. <br />a. No brewing equipment or storage is permitted on the exterior of the building. <br />b. Facilities for the on -site brewing of beer shall be no greater than ten thousand <br />square feet (10,000 s.f.) of floor area. Additional floor area may be permitted as <br />a conditional use. <br />4. Day Care Facility, Child and/or Adult. No such establishment may be located within <br />one thousand feet (1,000') of any existing day care facility, measured from lot line to <br />lot line. <br />5. Family Day Care Home, Type A and B. <br />a. According to ORC 5104.054, any Family Day Care Type, "B" home, whether <br />certified or not certified by the County Director of Human Services, shall be <br />considered to be a residential use of property for purposes of municipal, <br />county, and City zoning and shall be a permitted use in all Zoning Districts in <br />which residential uses are permitted. A Family Day Care, Type "B" home is a <br />permanent residence of the provider where childcare is provided for one (1) to <br />six (6) children and where no more than three children are under two years of <br />age. For the purposes of this definition, any children under six years of age who <br />are related to the provider and who are on the premises of the day care home <br />shall be counted. Family Day Care, Type "B" homes are a permitted accessory <br />use in the MAMU Overlay District. <br />JANUARY 24, 2025 13 <br />
